Our trading terms are straightforward and are designed
to assist you in your purchase decision.

Our payment/ordering system is secure and simple
and we don't store any credit card information for repeat orders/account purposes.

Postage rates are shown for UK/Europe/Rest of World, please select the appropriate option for your country of destination when ordering.

(1) SUPPLY OF GOODS

All goods remain the property of The Music Index until paid for in full.

Your contract with The Music Index in respect of purchase is completed when you receive confirmation of payment via PayPal.


(2) COPYRIGHT

All mp3 audio files are supplied for personal use only. They must not be used for commercial purposes or redistributed in any format (electronic or mechanical). The audio files remain the copyright of their respective copyright owners.


(3) PRICES

All prices are inclusive of VAT. A £5 (GBP) surcharge is currently made for orders to Australia and Canada. 


(4) PAYMENT OPTIONS

Payment can be made by credit card (Mastercard, Visa) and debit card (eg Solo, Maestro)

Please contact us if you wish to pay by cheque, International Money Order or bank transfer.

Please note we use PayPal for payment but you don't have to be signed up for PayPal to purchase: just select the pay by credit/debit card option at the checkout.


(5) GUARANTEES

All goods supplied are guaranteed against defects and faulty workmanship for a period of twelve months from date of purchase. Your statutory rights are unaffected.


(6) RIGHT OF CANCELLATION

You have the right to cancel any order within 7 days of receipt, without explanation.

You have the right to cancel any order within 30 days of receipt if the goods are faulty or incorrect or you have been overcharged.

Please note sealed CDs, DVDs etc must be returned in unopened packaging.


(7) REFUNDS (DAMAGED GOODS)

If goods are found to be faulty or damaged on receipt, please notify us in the first instance and return them to us securely packaged (in the original packing if possible).

We will either (a) refund your money (including your return postage costs) or (b) replace the item (and refund your return postage costs).

Refunds will be made by the method of payment option selected by the customer. (i.e. if you pay by credit card you will receive a credit card refund via PayPal).


(8) DISCLAIMER (MP3 FILES)

All mp3 files are supplied "as-is".  The Music Index shall not be responsible for any damage, corruption etc of hardware/software as a consequence of, or concomitant with, their use.


(9) DELIVERY TIMES

Goods are normally despatched within 48 hours of receipt of your order/ payment. If goods are out of stock we will advise you by email. If you order several CDs and some are out of stock we will hold your order pending instructions.

We can send the available CDs immediately but you may pay postage costs of the remaining titles to follow.

There may be times, especially during the Christmas or bank holiday periods, when we are unable to deliver within our normal delivery times. We will advise you via email.

We cannot be held responsible for any fluctuation in exchange rates after your purchase in respect of a refund if we cannot supply goods.


(10) TYPE OF GOODS SUPPLIED

Where possible The Music Index will supply the titles and editions as described on the website. 

In some cases, stocks may be nearing exhaustion or titles are deleted.  We will endeavour to supply those items that are currently out of stock although replacement stock may not be new and unused. 

All product supplied will however be in exceptional condition.  We will always advise customers of expected delays whilst we receive new stock.  We do have a very high success rate in sourcing deletions or hard to obtain items through our network of suppliers and labels and of course via existing stock if available.


(11) NON-RECEIPT OF GOODS

If goods are not received within 30 days of order,  the customer must advise us immediately as we cannot be held responsible after this time for goods lost in transit etc.


(12) STATUS REPORT

You will receive a notification of your order in an email via PayPal. Confirmation of payment, and shipping details, will be forwarded in a separate email headed "status report". For mp3 download, you will receive an URL (internet address) to allow download of the appropriate file (s).

Please check your spam or Junk mail folders in the event of non-receipt.

For future use, you can "mark not spam" if using Gmail or select the email and right-click to add to safe senders list (if using Outlook)

The various subject headers are as follows

Status Report - Despatch (to confirm despatch)
Status Report - Action Required (when some action needs to be taken by the customer)
Status Report - Refund (refund issued)
Status Report - Update (when we provide additional information)


(13) LOCAL TAXES & VAT

The customer is liable for all local taxes, duties and any VAT in their own country. This should be borne in mind, if you are ordering several CDs at the same time as it is likely that in most cases you will exceed the minimum level for customs duty liability.


(14) SECURITY OF CREDIT CARD PAYMENT/PERSONAL INFORMATION

The Music Index uses PayPal via a secure server connection. Your credit card details are encrypted (jumbled) on transmission and processed by PayPal. You can order using this method in complete confidence.

Please note our payment process does not store your credit card details - we do not ask you to set up an account with personal information before ordering. This will mean that you have to enter your details every time you order, however our system does take into account a browser session and will store your details until you close the browser.

If you keep your browser open, our system will temporarily store your personal information (unless you have 'cookies' * disabled on your computer - see our privacy policy)

If you are ordering on a public access computer (eg in a library or Internet cafe) we recommend you shut down the browser after placing your order or alternatively remember to close down the browser session before leaving the computer.

* A cookie is a temporary file placed on the end user's machine which enables us to identify the customer for ease of repeat ordering.
